1. Identity of the Data Controller

On 07.04.2016, the “Personal Data Protection Law” numbered 6698 (hereinafter referred to as the “Law”) was published and entered into force. Within the scope of the said law UÇAK TEXTILE, “Data Controller” and carries out the necessary compliance activities to fulfill the obligations required by this title. 2. Definitions

Personal Data: Refers to any information relating to an identified or identifiable natural person. Data such as name, surname, date of birth, place of birth, information on the physical, family, economic and other characteristics of the person, telephone number, motor vehicle number, identity number are personal data.

Sensitive Personal Data: Personal data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, health, criminal convictions and security measures, and biometric and genetic data.

Processing of Personal Data: Processing of personal data is any kind of operation performed on personal data such as obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data in whole or in part, automatically or non-automatically, provided that it is part of any data recording system.

Data Recording System: It is the recording system where personal data is structured and processed according to certain criteria. Bu sistemler elektronik yahut fiziki ortamda oluşturulabilir.

3. Conditions and Legal Grounds for Processing Personal Data

UÇAK TEKSTİL collects employee data automatically or non-automatically, verbally, on paper or electronically, through the channels listed below, at the time of employment and during employment in accordance with the relevant laws. The collected personal data are processed in accordance with the conditions specified below:

Except for the exceptions listed in the Law, it processes personal data only by obtaining the explicit consent of the data subjects. In the presence of the following cases listed in the Law, personal data can be processed even without the explicit consent of the data subject.

1. Explicitly stipulated in the law,
2. It is mandatory for the protection of the life or physical integrity of the person who is unable to disclose his/her consent due to actual impossibility or whose consent is not legally valid,
3. It is necessary to process personal data belonging to the parties to the contract, provided that it is directly related to the conclusion or performance of a contract.

• It is mandatory for the data controller to fulfill its legal obligation,

1. It has been made public by the person concerned,
2. Data processing is mandatory for the establishment, exercise or protection of a right,
3. Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Special sensitivity is shown in the processing of special categories of personal data, the security of which is critical for the data subjects.

• Provided that adequate measures determined by the Board are taken, such data are not processed without the explicit consent of the data subjects.
• Special categories of personal data other than health data may be processed if stipulated by law.

4. Method of Collection of Personal Data

UÇAK TEKSTİL collects personal data automatically or non-automatically, verbally, on paper or electronically, through the channels listed below, in order to carry out its business processes in accordance with the relevant laws. Your personal data

• Information forms and other documents on paper or electronically,
• By real or legal persons authorized by UÇAK TEKSTİL to process data, through correspondence, text messages sent via electronic mail addresses, hand delivery, declaration, cargo and other communication channels,
• With data from public institutions’ information technology applications,
• With applications that provide physical security such as camera systems, entrance systems,
• Through third parties, including health institutions, insurance agencies, consulting companies, law offices, banks that UÇAK TEKSTİL works with,
• With job application forms published in paper or electronic media,
• Documents submitted to UÇAK TEXTILE by the relevant persons via e-mail, cargo, reference and similar methods,
• Through employment agencies,
• With the researches conducted by UÇAK TEKSTİL in order to verify the accuracy of the information submitted by employees and employee candidates,

It is collected through various methods, verbally, in writing or electronically.

5. Personal Data Category

Your personal data collected are set out below:

 

Identity	Information contained in documents such as driver’s license, identity card, identity card, identity card, passport, marriage certificate, certificate of residence, civil registration certificate, civil registration certificate: TCKN, passport no., identity card serial no., name, surname, parents’ name, nationality, photograph, place of birth, date of birth, age, gender, marital status, place of registration, names and surnames of relatives.
Contact	Information processed for the purpose of contacting the data subject: Phone number, cell phone number, email address, contact address, street address, address of relatives, phone number of relatives.
Summary	All kinds of information and documents that are the basis for the formation of the personal rights of UÇAK TEKSTİL employees, which must be included in the personal file by law: Curriculum vitae, passport size photograph, military service status, SSI declarations, payroll information, wage statements, identity information of spouse and children, diplomas, certificates, education documents, annual leave forms, penalties and rewards given, family status notification form, blood type information, criminal record, civil registration certificate, residence certificate, employment contract, disability status report for disabled personnel, marriage certificate, regular examination and health reports, embezzlement minutes, payroll information.
Legal Action	Personal data processed for the determination and follow-up of legal receivables and rights and for the performance of debts or legal obligations: Data contained in documents such as court and administrative authority decisions, information in correspondence with judicial authorities, information in the case file, enforcement proceedings, power of attorney, etc.
Physical Space Security	Personal data contained in the records and documents taken at the entrance to UÇAK TEKSTİL buildings and offices and during the stay in the physical space: Entry and exit logs, visit information, camera records of electronic entrance tracking devices.
Transaction securityi	Personal data processed to ensure the technical, administrative, legal and commercial security of UÇAK TEKSTİL and related parties: Internet site user name, password and password information, internet traffic logs, ip addresses, PC mac ID information, application access logs, which show that the person is authorized to match the transaction associated with the personal data owner and to perform that transaction.
Finance	Personal data within the scope of information, documents and records showing all kinds of financial results created according to the type of legal relationship with the personal data owner: Bank account information, bank card number, advance payment information, salary information, payment history, BES contributions and policies, etc.

Audio and Visual Recordings	Audio-visual recordings associated with the personal data subject: Photographs, camera recordings, video and short films and sound recordings.
Health Information	UÇAK TEKSTİL health data in employees’ personnel files: Information on disability status, blood type, personal health reports, work accident reports, test and examination reports, devices and prostheses used, private health insurance policies.
Criminal Conviction and Security Measures	Criminal and conviction information of UÇAK TEKSTİL employees: Criminal record, judicial decisions, disciplinary investigations
Biometric Data	Fingerprint information used for access systems
Other-Signature and Initial	Signature and initials, signature circular
Other-Vehicle Information	License plate and registration information of the vehicle used, located or owned by the person concerned
Other-Title Information	Job and title information, business cards

Pursuant to the provisions of the law, it is essential to keep the information of natural persons accurate and up-to-date. For this reason, our employees may be requested to update their personal information at certain intervals. Employees are also expected to convey such information to the Human Resources and the relevant unit in case of any changes in their information. UÇAK TEXTILE cannot be held responsible for false information provided by the personnel under any circumstances.

6. Purposes of Processing Personal Data

Your personal data obtained by UÇAK TEXTILE is processed for the following purposes:

• Implementation of emergency management processes (emergency action plans, drills, etc.)
• Realization of information security processes (authentication, detection and control of entry and exit, etc.)
• Conducting employee candidate / internship selection and placement processes
• Carrying out the application processes of employee candidates
• Execution of Employee Satisfaction and Loyalty Processes
• Fulfillment of employment contractual and regulatory obligations for employees
• Conducting fringe benefits and benefits processes for employees (car allocation, telephone, personnel transportation, meal card, private pension, health insurance, etc.)

7. Transfer of Personal Data
   • Transfer of Personal Data Domestically

UÇAK TEKSTİL acts in accordance with the conditions regulated in the KVKK, without prejudice to the provisions of other laws regarding the transfer of personal data. Within this framework, personal data are not transferred by UÇAK TEKSTİL to other natural persons and legal entities without the explicit consent of the data subject. However, in the presence of one of the following conditions regulated by the LPPD, personal data may be transferred by UÇAK TEKSTİL to authorized institutions and organizations as stipulated in the legislation without obtaining the explicit consent of the data subject:

• Transfer of Personal Data Abroad

Regarding the transfer of personal data abroad, the explicit consent of the data subject is sought in accordance with Article 9 of the KVKK. However, in the presence of conditions permitting the processing of personal data, including sensitive personal data, without the explicit consent of the data subject, UÇAK TEKSTİL may transfer personal data abroad without seeking the explicit consent of the data subject, provided that there is adequate protection in the foreign country to which the personal data will be transferred.

If the country of transfer is not determined by the Personal Data Protection Board among the countries with adequate protection, UÇAK TEKSTİL and the data controller/data processor in the relevant country must undertake adequate protection in writing and the Personal Data Protection Board must have the permission of the Personal Data Protection Board.

• Organizations to which Personal Data is Transferred

Personal data may be transferred to the following domestic organizations in accordance with the legislation or the purposes set out in this text.

• The organizations that are partners in UÇAK TEKSTİL,
• UÇAK TEKSTİL to organizations with customers,
• Official institutions (Ministries, General Directorate of Security, courts, enforcement offices, etc.)
• Organizations providing public services (SSI, İş-Kur, Municipalities, etc.),
• Depending on the information technologies used by UÇAK TEKSTİL, companies and servers providing IT services such as cloud computing service, data center service, e-mail service, cyber security service, software development service,
• Persons and organizations from whom we receive services in order to carry out UÇAK TEKSTİL activities and to comply with legal requirements,
• Contracted organizations that provide our physical security
• Organizations auditing UÇAK TEKSTİL activities, independent audit firms, financial advisors, customs brokers and consultancy firms, law offices,
• Persons and organizations that we receive services for OHS legal requirements,
• Banks, insurance companies,
• Travel agencies, airline and rental companies and hotels

• Cargo companies.

8. Retention Period of Personal Data

Your personal data will be stored for the above purposes as long as your employment contract continues. Your personal data, which are required to be kept by law, will be kept for 10 (ten) years after the termination of your employment contract in accordance with the social security legislation. After the expiration of the period, your personal data will be deleted, destroyed and/or anonymized by UÇAK TEKSTİL or upon your request by methods within the scope of the Law on the Protection of Personal Data and related regulations.

9. Your Rights Regarding the Protection of Personal Data

Regarding the personal data processed by UÇAK TEKSTİL in accordance with the principles set out in this text, necessary measures have been taken to ensure that the rights recognized for the relevant persons in Article 11 of the KVKK are exercised. The rights in question are as follows:

1. Learn whether personal data is being processed,
2. Request information if their personal data has been processed,
3. To learn the purpose of processing personal data and whether they are used for their intended purpose,

• To know the third parties to whom personal data are transferred domestically or abroad,

1. To request correction of personal data in case of incomplete or incorrect processing,
2. To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law,
3. Request notification of the transactions made pursuant to (d) and (e) above to third parties to whom personal data are transferred,
4. To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,

• In case of damage due to unlawful processing of personal data, to demand compensation for the damage.

UÇAK TEKSTİL will finalize the request within thirty (30) days at the latest depending on the nature of the request. If the transaction requested by the relevant person requires an additional cost, the fee in the tariff determined by the Board may be charged.

Pursuant to Article 28 of the LPPD, the following situations are excluded from the scope of the LPPD, and the relevant persons cannot assert their rights listed above in these matters:

• Processing of personal data for purposes such as research, planning and statistics by anonymizing them with official statistics.
• Processing of personal data for artistic, historical, literary or scientific purposes or within the scope of freedom of expression, provided that such processing does not violate national defense, national security, public security, public order, economic security, privacy or personal rights or constitute a crime.
• Processing of personal data within the scope of preventive, protective and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public security, public order or economic security.
• Processing of personal data by judicial or enforcement authorities in relation to investigations, prosecutions, trials or executions.
